  • 1.  Evicting a tenant

    We have a tenant that has 2 spots rented at our boat and rv storage facility. She is currently past due 2 months on 1 spot and current until 9/2 on the other spot. We have made several attempts to contact her about this past due rent on spot 1. It's one excuse or promise after another.  We feel she is giving us the run around at this point and we are frankly tired of dealing with her.

    The spot she is past due on has been empty the 2 months she is past due. Today she had a " friend " come out to borrow the other trailer that is in the current spot. As of right now both of her spots are vacated. She said the borrowed trailer would be brought back tomorrow or the next day. We are of a mind to notify her tonight that she is no longer welcome to store either trailer here and move her out, write the 2 months off and go on down the road. We have denied her access at this point and had to let her friend in the get access to the trailer.

    Can we evict this tenant on a current spot for nonpayment on another? Can we deny her access to the property even though 1 spot is current?

    Right or wrong - I don't know, but those customers in my system who have multiple units have just 1 account. If they are late on 1 unit, the account is locked out. They can not gain access into the property. My software locks them out.

    We do the same.  We have them sign an addendum when renting additional units that say they are late with one they are late with all and that applies to all of our locations including our CoWarehouse facility (Kefi Spaces) and our executive office space (Business E Suites).

    as they have signed it in an addendum (written by our attorney), I'm confident it would hold up.

    I've had them test it, never in court, and when shown the addendum, they promptly pay!

    I would seriously kick them out!
