We have several customers with more than one spot rented on different contracts with different due dates. We do anniversary billing as opposed to prorate. One of our customers that has 2 spots is late on the rent for 1 spot and current on the other. We normally would turn the customers gate code off and not allow them access to the property until the rent is paid. Being current on the 2nd spot makes us question doing that.
Being late on rent for 1 spot is a breach of contract, but does that mean they are in breach of contract on both? The question only comes up because they have their travel trailer (which is the spot that is late) out on vacation. We didn't want to lock them out of the property and get ourselves in trouble since they are current on the other spot.
We are not worried about them not paying. They pay the late fees and never complain. This is more of question of what to do should this be drug out or this same issue arises with another multiple spot customer.
Keep in mind we are strictly RV, boat, and trailer storage. There is nothing to over lock. I guess it begs to question.... can we boot or tongue lock a trailer if rent is late?
