  • 1.  Commercial Company wants to Rent qtr of an acre

    We have 5 acres that we have our RV & Boat Storage on. Some are covered and some are open uncovered. We charge $40 for uncovered for a 40 x 12 space. There is a Company that would like to rent a qtr of an acre from us in the open. It is 10,890 sq ft in a qtr acre and I figured that I could rent 22 spots at $40 each for $880 or give a discount of $800 a month. This is undeveloped land that only has gravel and it does have some weeds. Please give us your thoughts. Thank you, Dawn Tucker

    Best use a TSAA form contract.  You will want to restrict occupancy to listed uses. Plus there are a ton of protections for both the tenant and the facility.   I would stay month-to-month until you find out what they really want to use the property for (ha! - a little storage humor).

    You may need TX state storage statutes on the books instead of evictions in a JP court.  See: Gold Book.

    This company will be laying lines for internet provider. It is a temporary situation and they want to keep their work trucks and supplies safe till the work is complete. Do you have any idea if 880 monthly is a fair amount?

    Use a TSSA form contract.  And check with your property insurer.  They may want a Certificate of Insurance from the tenant.

    My 2 cents is to assign them a specific part of your uncovered yard as their assigned parking space.  We have a little experience with parking spaces.  Assigning them a specific area of the yard will make it clear what your expectations are and will deter them from taking a covered parking space because it was empty.  A simple way to do this would be with some flexible orange sticks that pound into the ground OR use a 12" nail to anchor some orange cones to the ground.  The boundaries markers would be something that can handle being bumped, relatively cheap, and also durable.  

    My opinion on the rate is that your price seems fair as it's close to what you charge per sqft for a parking space.  Going by your price for a 12x40 my math says $0.08/sqft.  The quarter acre, or 10,890 sqft. comes to $907.50 rented at $0.08 per sqft.  

    I would also point out in the TSSA lease, that you provide a place to park and store equipment, nothing more.  There is no guarantee of security.  The last thing you want is a lawsuit or judgement against you because there was equipment theft while they parked at your storage property.  The theft risk should fall under the renter's commercial insurance policy.  Be sure that you do not assume that risk or say "OK" to the risk.  A lot of times an OK = YES.
