  • 1.  Renter ask for auction

    I have a long time renter of 4 large units who just informed me that she can no longer afford the units. (Already discounted)

    She said she will stop paying  and asked if I can auction the units for her at which time she will "give me a cut of the proceeds".

    What is the best way to proceed? I am not a thrift store after all.

    1) sorry to hear about this
    2) let the renter know they can clean out the units if they are current and move out. No problem and with them well.
    3) if they are saying it's now your problem…best is to get them to sign the form that says they are abandoning the unit. With that you can take the stuff and do whatever you want. If it is junk you have to haul off and or get rid of let the customer know you will remove and will charge their account a cleaning junk removal fee. If they can't pay for that it's too bad as you'll have to turn in their account balance to the collection agency and it will hit their credit. These are their costs not yours.
    4) if there is value, with the abandoned letter (letter is best but verbal conversation and documented notes in your system saying “they are abandoning the unit” is ok for me). Then sell the units and get what you can.

    Sorry this happened but in short clear the units as fast as you can so someone else can rent.

    I really had to laugh reading this post.  It's like your tenant thinks she is doing you a favor to "cut you in on the auction".  I would inform the customer that she will be getting a notice of sale because she has not paid the rent and that you will follow the standard auction process as set out in Chapter 59.  I am assuming she is currently behind on rent and as such is overlocked.  And coded out of the gate.   Don't let her on the property.  I would not let her have an auction on site or garage sale, even if she is current.  It will create a big disturbance for all the other customers.  Inform her if she wants to have an auction or garage sale she has to pay up and move everything off site.  If the units are large and you think they will bring substantially more than a months rent maybe you want to wait a few months to have the auction, giving her time to scrape together some money.  Sometimes people need help finding the funds to pay what is due. i.e. Ask her if she has anything she can pawn to get cash, any family or friends (although she has probably already burned them borrowing) that will loan her money.  Ther are some sites online that do loans I have heard advertise. Good luck.  You have the power. You have the contents of the units to sell.

    We insure self-storage facilities throughout Texas and I'd recommend that you follow the TSSA guidelines exactly, otherwise you could potentially end up with an insurance claim. I also agree with one of the other owners about not allowing her to do a sale on your property as this too will bring about unwanted exposure on your insurance policy. Good luck!

    That's exactly what she thought-you auction or sell other all for me and then give me the money!!!
